Habitumap
Terms of Use
Effective date: [EFFECTIVE DATE]
Draft for launch. Yellow brackets are placeholders, not finished facts. Do not treat them as a real email, company, or date.
1. Agreement
Habitumap is operated by Jason Jeong, an individual ("Habitumap", "we", "us"). These terms are between you and Jason Jeong for the Habitumap iPhone app, the Habitumap Mac app, and this website. By downloading the app or using the site, you agree to them. If you don't agree, don't use Habitumap.
The App Store download is also covered by Apple's terms. If those terms and these terms disagree about the store relationship (billing, refunds Apple controls, the license Apple requires), Apple's terms control that point. The Privacy Policy explains data. It is part of how we handle information, and it is not a promise that a feature ships on a particular day.
2. The product
Habitumap is a habit tracker. Each habit is a heatmap. You can log checks, counts, amounts, and time, mark a rest day, and track days you're avoiding something. iPhone and Mac are both part of the launch product, as one App Store listing.
The website is pre-launch. Descriptions on it are what we intend to ship. They can change before release. We don't promise a launch date. The early-access form does not, by itself, create an account or reserve a copy. See the privacy policy for the fact that the form is not connected to a mailing list yet.
There is no separate free tier in these prices. Features described as part of the app are part of the paid app, not a locked preview, except where a purchase screen in the app says otherwise before you pay.
3. Who can use it
You need an Apple Account to download from the App Store. Habitumap is not for children under 13. If the law where you live requires you to be older to agree to these terms, you have to be that age. You're responsible for the accuracy of what you put in habit names and notes.
4. License
We license Habitumap to you, we don't sell it. The license is personal, non-exclusive, non-transferable, and revocable. It lets you use the app on Apple devices you own or control, as the usage rules in Apple's Media Services terms allow. A universal purchase means the same Apple Account can use the iPhone app and the Mac app. You don't receive the source code, and you don't get a right to the name Habitumap.
You won't copy the app except as the device and Apple's rules allow, rent it out, or reverse engineer it except where a statute says that limit isn't allowed. Don't use the app to break the law, to harass someone, or to store someone else's private information in a note when you don't have a right to. Don't present Habitumap as medical treatment.
5. Your habit data
You keep whatever rights you have in the habit names, notes, and logs you enter. We don't take a license to that content in order to publish it, because the product is built so we don't receive it. It stays on your devices and, if you use iCloud, in your private iCloud. You're responsible for your own exports. Anonymous usage stats, if they are ever sent, are the categories in the privacy policy, not the text of your habits.
6. Prices
Prices on this website are in US dollars, for the United States store:
- Habitumap Monthly. $2 per month. Length: one month, renewing.
- Habitumap Yearly. $24 per year, with an introductory price of $12 for the first year (50% off). After the first year, the plan renews at $24 a year until you cancel.
- Habitumap Lifetime. $35 once. It is not a subscription and it does not renew.
The App Store shows the price for your region, including how tax is presented, before you confirm. That confirmed price is the one that applies, even if this page still shows the US number. We may change prices for new purchases. A price change on an existing subscription follows Apple's rules, which can require your agreement before the new price is charged.
What you get is the paid Habitumap app on iPhone and Mac: the habit tracker described in the app, for the Apple Account that bought it. We don't sell a separate "pro" lock inside widgets.
7. Subscriptions and auto-renewal
Payment is charged to your Apple Account when you confirm the purchase. A monthly or yearly subscription renews automatically unless you turn auto-renew off at least 24 hours before the end of the current period. Apple charges the renewal to your account within 24 hours before the end of the current period, at the then-current price unless Apple's price-change rules say otherwise.
You manage and cancel subscriptions in your Apple Account settings (Settings, then your name, then Subscriptions, on iPhone). Canceling stops the next renewal. You keep access through the end of the period you already paid for. Deleting the app does not cancel a subscription. We can't cancel an Apple subscription for you from inside our own systems, because Apple is the seller of record.
No free trial is part of the prices above. If we later offer a free trial, the length and the price that follows it will be on the App Store sheet before you confirm. Any unused portion of a free trial is forfeited when you purchase a subscription, where Apple applies that rule.
8. Lifetime
Lifetime is a one-time in-app purchase for the same Apple Account. It unlocks Habitumap on the iPhone and Mac platforms included in that universal purchase, for as long as we offer the Habitumap app on the App Store.
It is not a promise that Apple, iOS, or macOS will run an old build forever, and it is not a promise that we will ship every future platform or a separate product under the same purchase. If we stop offering Habitumap, we won't bill you again. Lifetime is not a balance we hold for you. Any refund of the original charge is Apple's decision under section 9.
9. Refunds
Apple handles billing and refunds. Request a refund at reportaproblem.apple.com or through Apple's support. We don't receive your card payment and we can't issue the refund ourselves. Apple may grant or decline a request under its own rules. We don't promise a refund for unused subscription time after a period has started.
10. Not medical advice
Habitumap is not a medical device, not therapy, and not medical, dietary, or addiction-treatment advice. Avoid mode can record days you stayed within a limit you chose, including for nicotine, alcohol, sugar, or anything else you decide to track. That record is not a treatment plan, not a diagnosis, and not a promise about quitting. Don't use the app as a substitute for a qualified professional. If you may be in danger, contact local emergency services. We are not responsible for health decisions you make while using a habit tracker.
11. Acceptable use and availability
Don't interfere with the app, with Apple's services, or with anyone else's devices. Don't probe the app for a purpose other than your own habit tracking. The app depends on your device, on iCloud if you use sync, and on the App Store. Sync can pause, including when iCloud storage is full or the network is down. Local logging is meant to keep working in those cases. We don't promise uninterrupted service.
12. Disclaimers
The app and this website are provided "as is" and "as available." To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement, and any warranty that habit data will never be lost, that sync will always succeed, or that the app will be error-free. iCloud is Apple's service. Some places don't allow a disclaimer like this. In those places it applies only as far as it legally can, and you may have rights that can't be waived.
If the app fails to conform to an applicable warranty that the law won't let us disclaim, you may notify Apple, and Apple may refund the purchase price for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or health outcomes, even if we knew they were possible. Our total liability for a claim relating to the app or the website is limited to the amount you paid for Habitumap in the 12 months before the claim, or fifty US dollars if you paid nothing.
This limit does not apply to liability the law says we can't limit, including fraud, or death or personal injury caused by negligence where a statute forbids the limit. Some places don't allow certain limits. In those places, the limit applies only as far as it legally can.
14. Indemnity
If a third party brings a claim against us because of your misuse of the app or because of text you stored in it, you agree to cover the resulting damages and reasonable costs, to the extent the law allows. This does not apply where the law doesn't let us ask for it, and it does not shift a claim that exists because of our own legal fault.
15. Apple
You and we agree, because Apple requires it for a custom license:
- These terms are between you and us, not between you and Apple. We are responsible for the app and its content, not Apple.
- The license is limited, non-transferable, and covers use on Apple-branded products you own or control, as Apple's usage rules allow.
- We are responsible for maintenance and support. Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligation for the app, to the maximum extent the law allows.
- We, not Apple, are responsible for product claims, including product liability, legal or regulatory failures, and consumer-protection claims, to the extent those claims aren't Apple's under the law.
- We, not Apple, are responsible for investigating and defending a third-party claim that the app infringes intellectual property, and for any resulting costs.
- If you are a US government end user, the app is commercial computer software under the applicable federal acquisition rules.
- You comply with applicable third-party terms when you use the app, including your wireless agreement if it applies.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.
16. Ending use
You can stop using Habitumap and delete it at any time. Deleting it does not cancel a subscription. We can stop offering the app, or refuse a use that breaks these terms, where the platform allows. Sections that should survive by their nature (disclaimers, liability, Apple's beneficiary rights, governing law) survive.
17. Changes to these terms
We may update these terms by posting a new version on this page and changing the effective date. If you keep using the app after that date, the new terms apply where the law allows a change that way. If a change is one the law says we have to bring to you another way, we will. Price and renewal terms that Apple showed you at purchase stay governed by Apple's purchase rules for that transaction.
18. Governing law
These terms are governed by the laws of [JURISDICTION/GOVERNING LAW STATE], excluding conflict-of-law rules, except where the consumer law of your home won't allow that choice. Courts in that place hear disputes, except where a non-waivable consumer law lets you sue at home. We don't require arbitration, and we don't waive a class action in this draft. Write to jeongjason5914@gmail.com first if something is wrong. That's a request, not a barrier to a claim the law lets you file.
19. Other
If a section is unenforceable, the rest still applies. These terms are the whole agreement between you and us about the app and the website, along with the privacy policy and the terms Apple applies to the download. We may assign them if the product moves to a new owner. You may not assign your license except as Apple's rules allow. A delay in enforcing a term is not a waiver.
